These terms & conditions set out the basis on which you can visit and use our website. Please read them carefully as they contain important information.

General terms and conditions

Ownership of rights
All rights, including copyright, in this website are owned by or licensed to BSAVA. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use is prohibited without the permission of BSAVA. You may not modify, distribute or re-post anything on this website for any purpose.

Variation to Conditions
We reserve at our absolute discretion the right to vary these Conditions of Use and any other basis upon which this site is to be used. As such, we suggest that you consult periodically this portion of the website so as to check for any changes but please note that your use of the site will be deemed to mean that you have accepted whatever Conditions of Use prevail at the time of such usage of the website as implying that you accept the basis upon which we want our website used.

Usage of Site
At any time and at our absolute discretion, we may notify you by e-mail, fax or any other communication means, that we require you to desist forthwith from using this website and upon receipt of such notice, you will promptly cease use of the website and destroy all materials downloaded or otherwise obtained from this site in your then possession, custody or control, as well as all copies of such materials.

Accuracy of content
BSAVA has taken every care in the preparation of the content of this website, in particular to ensure that prices quoted are correct at time of publishing and all products have been fairly described. However, orders will only be accepted if there are no material errors in the description of the goods or their prices as advertised on this website. All prices are displayed inclusive of VAT. Packaging may vary from that shown. The weights, dimensions and capacities given are approximate only. We have made every effort to display as accurately as possible the colours of our products that appear on the website. However, as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor's display of any colour will accurately reflect the colour of the product on delivery. To the extent permitted by applicable law, BSAVA disclaims all warranties, express or implied, as to the accuracy of the information contained in any of the materials on this website. BSAVA shall not be liable to any person for any loss or damage which may arise from the use of any of the information contained in any of the materials on this website.

Damage to your computer
BSAVA makes every effort to ensure that this website is free from viruses or defects. However, we cannot guarantee that your use of this website or any websites accessible through it won't cause damage to your computer. It is your responsibility to ensure that the right equipment is available to use the website and screen out anything that may damage it. BSAVA shall not be liable to any person for any loss or damage which may arise to computer equipment as a result of using this website.

You are responsible for maintaining the confidentiality of your password and account and any activities that occur under your account. BSAVA shall not be liable to any person for any loss or damage which may arise as a result of any failure by you to protect your password or account.

Availability
All items are subject to availability. We will inform you as soon as possible if the goods you have ordered are not available.

Ordering errors
You are able to correct errors on your order up to the point at which you click on ‘submit’ on the final page of our ordering process.

Delivery charges
Delivery charges vary depending on the type of products ordered and the service you select and cannot be refunded.

Acknowledgment and acceptance of your order
If you have supplied us with your email address, we will notify you by email as soon as possible to confirm receipt of your order and email you again to confirm details.

Delays
Occasionally, your goods may be delayed. This can be for various reasons such as material shortages, import delays or higher than anticipated demand. We will, of course, make every effort to keep you informed.

Cancellation right
Under the distance selling regulations you have the legal right to cancel your order within seven working days of receipt of the goods.  Where goods are delivered to a third party you will only be able to exercise this right if you are able to return to us the goods you ordered.

Links to other websites
We have placed links on this website to other websites we think you may want to visit. We do not vet these websites and do not have any control over their contents. BSAVA cannot accept any liability in respect of the use of these websites.

Exclusions of liability
Any disclaimers and exclusions of liability in these terms & conditions shall not apply to any damages arising from death or personal injury caused by the negligence of BSAVA or any of its employees or agents or fraud. These disclaimers and exclusions shall be governed by and construed in accordance with English Law. If any provisions of these disclaimers and exclusions shall be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

We reserve the right to change these terms & conditions from time to time and you should look through them as often as possible.

BSAVA make no representation that any products or services referred to in the materials on this website are appropriate for use, or available, in other locations. Those who choose to access this site from other locations are responsible for compliance with local laws if and to the extent local laws are applicable.

Law, jurisdiction and language
This website, any content contained herein and any contract brought into being as a result of usage of this website are governed by and construed in accordance with English Law. The parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales. All contracts are concluded in English.

These terms and conditions do not affect your legal rights.

We will treat as confidential all of the Personal Information you give to us when you register with us using the facility on this website. This includes your name, address, email address, telephone contact number(s), gender, date of birth and whether you are a member of the Association.

The Personal Information given to us will be used to assist us in providing you with marketing material, including information about special offers, promotions, as well as providing you with information regarding the areas that you have indicated are of interest to you. We will contact you by email, post or telephone using the contact details given to us.

BSAVA will never share your individual Personal Information with any third party without your prior permission. 

Your Personal Information is protected in the United Kingdom by the Data Protection Act. You have the right to request in writing to receive a copy of the Personal Information held by BSAVA and the source of the Personal Information. We may charge a £10 fee for providing the Personal Information to you. You have a right at any time to request us to stop sending you marketing information. Bookstore & On-line Trading Terms & Conditions

General

  1. While we try and ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.
  2. You agree that e-mail can be used as a long-distance means of communication.
  3. The British Small Animal Veterinary Association will not keep details of your personal or credit or debit cards as our secure payment-processing provider processes them. We shall be entitled to process your data in accordance with the terms of our Privacy Policy. Please view this document for further information.
  4. You undertake that all details you provide to The British Small Animal Veterinary Association for the purpose of ordering or purchasing goods or services are correct, that the credit or debit card you are using is your own, that there are sufficient funds to cover the cost of the goods or services ordered and that your membership status is as per your order.
  5. You must choose a username and password on completion of registration. You are responsible for all actions taken under that username and password and shall only use the Site under your own username and password. You must make every effort to keep your password safe and should not disclose it to anyone. If it is compromised, you must change it. You may not transfer or sell your username to anyone, nor permit, either directly or indirectly, anyone to use your username or password.
  6. If there are any changes to the details supplied by you it is your responsibility to inform The British Small Animal Veterinary Association as soon as possible.
  7. All purchases are non-exchangeable, non-refundable and non-transferable.
  8. You may cancel your order at any time prior to your order being processed by emailing customerservices@bsava.com or by post or by telephoning 01452 726700 during normal office hours. You may also withdraw from the contract at any time after the product has been dispatched but no later than 7 working days after the day after you receive the product by:
  9. Sending the notice of cancellation by email to customerservices@bsava.com ensuring that you quote your name, address and order reference number; or
  10. Where you have already received the goods, returning the goods to The British Small Animal Veterinary Association unopened together with the original invoice. The British Small Animal Veterinary Association will refund you the purchase price of the goods. Where appropriate The British Small Animal Veterinary Association shall refund any additional customs duties borne by you on receipt of the relevant customs receipt.
  11. Once The British Small Animal Veterinary Association receive notification from you that you wish to withdraw from the contract (in accordance with these terms), any sum debited to The British Small Animal Veterinary Association from your credit card in relation to your order will be re-credited to that credit card account as soon as possible and in any event within 30 days of your order provided that the goods you wish to return are received by The British Small Animal Veterinary Association in the condition that they were in when delivered to you. You will be liable for any charges incurred in returning the goods to The British Small Animal Veterinary Association.
  12. The British Small Animal Veterinary Association reserves the right to make a 15% restocking charge for any goods which are not returned in mint condition or to refuse to accept such goods, at its sole discretion. The British Small Animal Veterinary Association also reserves the right to make a charge for collecting goods from your premises in circumstances where they are not defective but you have cancelled your order. Your statutory rights are not affected.

Liability

  1. This section applies only to the extent permitted by law. For the avoidance of doubt, The British Small Animal Veterinary Association do not exclude or limit any liability for (a) personal injury (including sickness and death) where such injury results from The British Small Animal Veterinary Association’s negligence or wilful default, or that of The British Small Animal Veterinary Association's employees, agents or subcontractors or (b) fraudulent misrepresentation.
  2. The British Small Animal Veterinary Association does not accept liability (except as set out below) for any errors and omissions and reserve the right to change information, prices, specifications and descriptions of listed goods, products and services.
  3. If an error is discovered in the price of the goods that you have ordered, we will inform you as soon as possible. In the event that you order an item and the price published on the Site is incorrect for any reason, we will contact you to let you know the correct price and ask you whether you still wish us to fulfil your order at this price. We shall be under no obligation to fulfil an order for a product, which was advertised at an incorrect price. We shall give you the option of confirming the order at the correct price or if you so choose, to cancel the order altogether. If you cancel and have already paid for the goods in the circumstances described in this clause, we shall refund the full amount in accordance with these Terms.
  4. The British Small Animal Veterinary Association will do its best to correct errors and omissions as quickly as practicable after being notified of them.
  5. In the unlikely event that you receive goods which were not what you ordered or which are damaged or defective, or are of a different quantity to that stated on your order form, The British Small Animal Veterinary Association shall, at its own option, make good any shortage or non-delivery, replace or repair any damaged or defective goods, or refund to you the amount you paid for the goods in question PROVIDED THAT you notify The British Small Animal Veterinary Association of the problem in writing at the address stated in the confirmation e-mail within 10 working days of delivery of the goods. NOTHING IN THIS CLAUSE AFFECTS YOUR STATUTORY RIGHTS.
  6. You and The British Small Animal Veterinary Association will only be liable under these Terms for losses, which are a reasonably foreseeable consequence of the relevant breach of contract.

Processing of orders

  1. The British Small Animal Veterinary Association debits, credit cards and debit cards prior to shipping. All prices include sales taxes (where applicable) unless otherwise stated.
  2. The British Small Animal Veterinary Association aims to arrange shipment of all ‘in stock’ items within 1 working day of receiving your order. Your order may be delayed if the item is not in stock with our suppliers. Some items may be unavailable and the current stock status is approximate. The British Small Animal Veterinary Association is not able to supply dates our suppliers may get an item in stock.

Delivery/title/risk

  1. The period stated within which you will receive your order is approximate. Goods will be sent to the address given by you in your order. Please note that your goods may be sent to you in instalments. You may cancel your entire order with us if subsequent instalments forming part of your order are not delivered by us.
  2. Title to any product ordered will pass to you once The British Small Animal Veterinary Association has received payment in full for that product. Risk in any product ordered will pass upon delivery to you.
  3. If your delivery address is outside the United Kingdom, you may be subject to import duties and taxes, which are levied once a shipment reaches your country. Any such additional charges for customs clearance must be borne by you. You should note that customs policies vary widely from country to country; The British Small Animal Veterinary Association advises each customer to contact their local customs office for further information.
  4. Please note that when shipping products internationally, you should be aware that cross-border shipments are subject to opening and inspection by customs authorities.
  5. For Christmas Deliveries, we recommend that you order by the 18th December. We will endeavour to despatch all ‘in stock’ orders within 24 hours, however we cannot guarantee delivery on or before the 24th December as the post may be delayed in your area.

Miscellaneous

  1. We shall have no liability to you for any delay in the delivery of products ordered or any other matters to the extent that the delay is due to any event outside our reasonable control, including but not limited to ‘acts of God’, war, flood, fire, labour disputes, strikes, lock-outs, riots, civil commotion, malicious damage, explosion, governmental actions and any other similar events.
  2. We shall have no liability (including liability for negligence) for the acts or omissions of telecommunications service providers or for failures of, or faults in their networks and equipment.
  3. No waiver by us of any breach of these Terms shall be considered as a waiver of any subsequent breach of the same or any other provision.
  4. It is a crime to use a false name or a known invalid credit card to order. Anyone caught wilfully entering an erroneous or fictitious order will be prosecuted to the fullest extent of the law.
  5. We reserve the right to terminate this Agreement and to suspend or terminate your access to the Site immediately and without notice to you if:
  6. You fail to make any payment to us when due;
  7. You breach the terms of this Agreement (repeatedly or otherwise);
  8. When requested by us to do so, you fail to provide us within a reasonable time with sufficient information to enable us to determine the accuracy and validity of any information supplied by you, or your identity;
  9. We suspect you have engaged, or about to engage, or have in any way been involved, in fraudulent or illegal activity on the Site.
  10. The British Small Animal Veterinary Association may amend these Terms from time to time, and place the new version on the Site. When The British Small Animal Veterinary Association do so, it will mention the fact on our home page (www.bsava.com). For users purchasing goods or registering on the Site for the first time, all purchases from the date that the amended terms are placed on our website onwards will be governed by those new terms Otherwise, such changes will be effective against existing users thirty days following posting of the amended version on the Site. Your continued use of the Site following The British Small Animal Veterinary Association’s posting of any changes will constitute your acceptance of such changes. If you do not agree to any changes to these Terms, then your only remedy is to cease using the Site.
  11. These Terms supersede any and all other conditions, understandings, commitments, agreements or representations (except fraudulent misrepresentations) relating to your purchase, whether oral or in writing, and contain the entire agreement between The British Small Animal Veterinary Association and you relating to your purchase. The British Small Animal Veterinary Association advises that you print off and keep safe a copy of these terms and conditions once The British Small Animal Veterinary Association has accepted your order.
  12. If any provision of these Terms shall be held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the remaining parts of these Terms and the remainder of the affected provision shall be unaffected.
  13. English law shall govern this Agreement and the parties submit to the exclusive jurisdiction of the English courts.
